These Terms and Conditions of Service and Use of LivEvolved website (referred as "Website”, and sometimes referred to herein as “we” or” us” or “our” or “Company”) are hereby made effective, and, without waiving or otherwise releasing any right or obligation under any prior terms and conditions of the use of LivEvolved hereby amend and restate any such prior terms and conditions.

The words "You" or "User" "Your" as used herein refer to all individuals accessing or using the Website for any reason.

By using the Website, you represent that you have read and agree to be bound by the terms of this Agreement, as well as any other guidelines, privacy policy, rules and additional terms referenced herein, collectively referred to as "Terms and Conditions". These Terms of Use set out the legally binding terms with respect to your access and use of the Website and our provision of the Services.

SECTION 1- USER OBLIGATION

Without limiting the generality of the foregoing or any other provision hereof, you acknowledge and agree, as follows:

10. Not to issue chargeback disputes against us;

11. Not to use patented, copyrighted, trademarked or other protected intellectual property without the written consent and authorization of the owner of such property;

12. Not to copy, distribute or disseminate the Website or any portion thereof, and not to transfer the Website, or any portion thereof, to another person or “mirror” the Website, or any portion thereof, on any other server;

13. Not to decompile or reverse engineer, or attempt to decompile or reverse engineer, the Website or any portion thereof.

SECTION 2- DIGITAL FILE QUALITY

We are committed to provide high-quality videos for tarot readings. Unless otherwise specified, we may deliver, and client agrees to accept, the digital file encoded in an industry-standard data format that we may select, at a resolution that we determine will be suitable to the subject matter of the digitals and the reproduction technology and use for which the digital is licensed.

Due to variances in monitor calibrations, software, and computer websites, digital files may display differently on different monitors.

SECTION 3- ERRORS AND OMISSIONS​

This Website is a public resource of general information that is intended, but not promised or guaranteed, to be correct, complete, and up-to-date. We have taken reasonable steps to ensure that the information contained is accurate, but we cannot represent that, it is free of errors. You accept that the information contained on this website may be erroneous and agree to conduct due diligence to verify any information obtained from this website and/or resources available on it prior to taking any action. You expressly agree not to rely upon any information contained in this website. ​

SECTION 4- CODE OF ETHICS

By enlisting the services of LivEvolved, you are agreeing to the following Code of Ethics:

1. The purpose of LivEvolved readings is to empower the client.

2. LivEvolved clients will keep everything a client says and everything that is revealed in a reading 100% confidential, unless the situation is possibly life-threatening.

3. LivEvolved LLC are non-judgmental, and we welcome clients of all cultures, religions, spiritual paths and sexual orientations.

4. LivEvolved will not do a reading or coaching session for third parties to see what someone other than the client is doing or feeling, nor will they do a reading or coaching for anyone under 18 years old.

5. LivEvolved will strive to give clients positive direction and guidance, to help them to find practical and empowering courses of action.

6. LivEvolved will not give advice in areas for which they are not qualified. If the client needs a physician, psychologist, lawyer, financial advisor, accountant, or any other professional service for which the reader is not qualified, they will encourage them to seek such service from someone who is qualified in that area.

7. LivEvolved reserves the right to refuse to do a reading for a question that they feel they cannot answer, or one that goes against this Code of Ethics.

8. All client sessions are completely confidential and will never be revealed to a third-party.

9. Life coaching sessions may address specific personal life struggles, business issues, or general conditions in the client's life or profession. Coaching also includes values, thought storming, identifying action plans, examining modes of operation in life, asking clarifying questions, and making empowering requests or suggestions for action. Additionally, you may be asked to reflect on difficult topics or situations which may result in an expression of emotions.

10. You are very much encouraged to talk more as to receive a better understanding of what coaching is about and how to get the most out of it.

11. You understand that coaching is not a substitute for counselling, psychotherapy,
psychoanalysis, mental health care or substance abuse treatment, and you will not
use it in place of any form of therapy.

12. You understand that all comments and ideas offered by LivEvolved are solely for
the purpose of aiding you in achieving your defined goals.

13. You understand that to the extent our work together involves career or business, LivEvolved is not promising outcomes included but not limited to increased
clientele, profitability and or business success.

SECTION 5- PERSONAL RESPONSIBILITIES

You aim to accurately represent the information provided to us on or through our website. You acknowledge that you are participating voluntarily in using our website and that you are solely and personally responsible for your choices, actions, and results, now and in the future. You accept full responsibility for the consequences of your use, or non-use, of any information provided on or through this website, and you agree to use your own judgment and due diligence before implementing any idea, suggestion, or recommendation from our website to your life, family or business.

You must be at least eighteen (18) years of age to use the Website, unless the age of majority in your jurisdiction is greater than eighteen (18) years of age, in which case you must be at least the age of majority in your jurisdiction. Use of the Website is not permitted where prohibited by law.

SECTION 6- LIMITED LICENSE
You may access and view the Website on your computer or other internet compatible device for your personal, non-commercial use only. To the extent you need to download software or documentation to use the products or services on the site, we grant you a limited, non-assignable, non-transferable, revocable license to use such materials solely to utilize such products or services. Such license will terminate when you no longer use our services.

SECTION 7- ONLINE PAYMENTS

You represent and warrant that if you are making online payments that (i) any credit card, debit card and bank account information you supply is true, correct and complete, (ii) charges incurred by you will be honored by your credit/debit card company or bank, (iii) you will pay the charges incurred by you in the amounts posted, including any applicable taxes, and (iv) you are the person in whose name the card was issued and you are authorized to make a purchase or other transaction with the relevant credit card and credit card information. SECTION 8- CONFIDENTIALITY AND NON-COMPETE

Client hereby understands that the tools, processes, strategies, materials and information presented in the sessions and recordings are confidential, copyrighted, and proprietary to the LivEvolved and agrees not to record, duplicate, distribute, teach or train from thematerials in any manner whatsoever without the express written permission of LivEvolved. Any unauthorized use or distribution of these proprietary concepts, materials, and intellectual property by you or your representatives is prohibited and the we will pursue legal action and full damages if these terms are violated in order to protect its rights.

SECTION 9- VIRTUAL SESSIONS

To ensure smooth virtual sessions, you may require multiple compatible devices, high speed internet access. You are solely responsible for all computer hardware and other equipment and all fees for services (such as internet service and wireless services) required for access and use of online sessions. You may regularly need to update your video conference applications to use our services. You acknowledge and agree that such system requirements, which may be changed from time to time, are your responsibility and are to be procured at your own cost.

SECTION 10- REFUNDS AND CANCELLATIONS

Once your booking has been confirmed a contract will exist between you and us. All payments related to tarot reading services are nonrefundable once the videos have been sent to you. Your spiritual life coaching sessions can be rescheduled or cancelled before commencement of the session. If you wish to reschedule or cancel your appointment you must notify us within 24 hours prior to your appointment. You will be charged if we do not receive any rescheduling/cancellation requests before 24 hours of commencement of your appointment.

We reserve the right to cancel or change booking date of your appointment. In case of emergency situations, your appointment may be cancelled or postponed without any notices from us.

SECTION 11- HYPERLINKS
LivEvolved makes no claim or representation regarding the quality, content, nature or reliability of third-party websites accessible by hyperlink from the website. Such websites are not under our control and we provide these links to you only as a convenience. The inclusion of any link does not imply our affiliation, endorsement or adoption of any websites or any information contained therein. Except as otherwise provided herein, when you leave the Website, you should be aware that our terms and policies no longer govern. You should review the applicable terms and policies, including privacy and data gathering practices, of any websites to which you navigate from our Website.

SECTION 12- LIMITATIONS ON USE

You may not reproduce, resell, or distribute our sessions or services for any purpose unless you have been specifically permitted to do so under a separate agreement with LivEvolved. You may not sell or enable any third parties to resell the Content purchased by You, display on any Website or otherwise publish the services or any Content obtained from a Service or otherwise generate income from the services or use the services for the development, production or marketing of a service or product substantially similar to our services.

SECTION 13- INDEMNIFICATION
To the fullest extent permitted by applicable law, you agree to indemnify, defend and hold harmless LivEvolved and our respective past, present and future employees, officers, directors, contractors, consultants, equity holders, suppliers, vendors, service providers, parent companies, subsidiaries, affiliates, agents, representatives, predecessors, successors and assigns from and against all actual or alleged LivEvolved Party or third party claims, damages, awards, judgments, losses, liabilities, obligations, penalties, interest, fees, expenses and costs of every kind and nature whatsoever, whether known or unknown, foreseen or unforeseen, matured or unmatured, or suspected or unsuspected, in law or equity, whether in tort, contract or otherwise (collectively, “Claims”), including, but not limited to, damages to property or personal injury.
